Legislative Update - Arbitration Agreement
Arbitration Agreements are a key workplace issue on the Supreme Court docket this term that could shape workplace policies and practices.
Arguments for Lamps Plus Inc. v. Varela, U.S., No. 17-988 will be heard on Oct 29th – addressing the question of whether a signed arbitration agreement waived the employee’s right to bring forth a class action arbitration.
New Prime Inc. v. Oliveira, U.S., No. 17-340 was argued on Oct 3rd and is pending an opinion. It will address whether arbitration agreements are enforceable for truck drivers who are classified as independent contractors.
The guidance for employers is to take extra care to have clearly defined agreements.
At the state level, the Kentucky Supreme Court recently ruled employers can’t force new hires to sign arbitration agreements. With this decision, NKADD vs Snyder, KRS 336700(2), Kentucky is now the only state that says such agreements are null and void.
