Legislative Update - Kentucky Medical Review Panel (MRP) Act
On November 15th the KY Supreme Court unanimously struck down a 2017 law that required people to first submit their cases to an outside panel for review before filing a lawsuit for medical malpractice. They decided the MRP Act violates the Kentucky Constitution and focused on Section 14 which protects one’s right to a speedy trial.
Supporters of the decision highlight how the law created a large backlog of several hundred cases awaiting assignment and review while relative few cases had been decided. The Circuit Clerk judge stated the law “protects the economic interests of the health care industry at the expense of consumers, with no demonstrable benefit to the public at large.”
Supporters of the MRP Act say this decision is to the detriment of businesses and caregivers citing the litigation free friendly environment. The US Chamber of Commerce Institute for Legal Reform ranks Kentucky 43 out of 50 states for its legal liability climate. The Kentucky Medical Association (KMA) agrees stating it discourages physician recruitment while increasing patient costs, pointing out that skilled nursing facilities are already leaving the KY market.
As a result, businesses, health care providers and health care professionals must now be prepared to address claims as it is expected that any cases currently part of the process will be immediately filed in Kentucky State Court.
Silent Auction for SHRM a Success
A silent auction was held during the November 13th chapter meeting, and $2360.00 was raised for the SHRM Foundation. Thanks go to board members and volunteers who contributed a bottle of wine and/or a gift card. Many thanks to the members who contributed beautiful baskets that attendees could not resist. And lastly, thanks to the volunteers who helped build baskets, create a lovely event table, and to those who worked to ensure a smooth check-out. With the silent auction and basket sales at chapter meetings, we have raised $3200 this year. STILL, you help is requested. If you have not yet made your contribution, donations for 2018 are accepted through December 31, 2018.
