Legislative Update:

Arbitration Agreement Ruling


The Supreme Court has ruled in favor of Dominic Oliveira, owner and independent contractor, in an arbitration clause case. The wage class action case, New Prime Inc. v. Oliveira, U.S., No. 17-340, was mentioned in the Oct 23rd issue of The Light Post. The Court has ruled that legal disputes between carriers and independent contractors cannot be forced into private arbitration even if their contractor agreements include an arbitration cause. It is an exception to the 100 year old Federal Arbitration Act (FAA) which is generally presumed o favor employers.

While the decision was 8-0, it is narrow in scope and leave many questions unanswered. It focuses on the trucking industry and it is unclear whether it would apply to truckers who do not cross state lines. However, it Is considered to be the first of several as the court has taken at least three arbitration cases this term.

Employment Symposium Educating on Opioid Addiction


Opioid Addiction is a critical employment issue for Companies to address. The LSHRM Wellness Team would like to keep our LSHRM Members informed and encourage more education on this topic by attending an upcoming Employment Symposium hosted by the South Louisville Opioid Task Force on January 29th, from 8:30am-12:30pm, at the Southwest Regional Library.
