KY Arbitration Law
On March 25, 2019, Governor Bevin signed into law a bill that reaffirms an employer’s right to use arbitration agreements. The law substantively amends the language of two state statutes: KRS § 336.700 and KRS § 417.050.
This development comes on the heels of the Kentucky Supreme Court’s controversial decision last September in Northern Kentucky Area Development District v. Snyder, Case No. 2017-SC-00277. Reported in an October 2018 edition of The Lightpost Legislative Update which stated the Kentucky Supreme Court ruled employers can’t force new hires to sign arbitration agreements; making Kentucky the only state that says such agreements are null and void.
The Kentucky legislature reacted swiftly to this decision, decrying the possibility that Kentucky could be perceived as the only state where employers could not require arbitration as a condition of employment and the bill quickly reached the governor’s desk for signature.
Ultimately, the FAA still governs arbitration agreements that meet the Act’s criteria. However, Kentucky’s swift legislative action provides much-needed clarity for arbitration law in the Commonwealth.
All told, Kentucky’s new law provides employers with a key opportunity to reexamine arbitration and other employment agreements.

Does your company have internships it is looking to fill? Well look no further, LSHRM recently created a new internship portal located in the workforce section of the LSHRM website. Internship Central is a new resource that has been created to house internships (from any field of study) that are available from employers in the Greater Louisville region. Not only is this resource available at no charge to LSHRM members, there is no cost for non-LSHRM members as well. Our hope is that this site will serve as a one-stop resource for local colleges and universities. Launched in late October, the site is still fairly new, but ready for you and your colleagues to post any available internships. Check it out and let us know what you think!
