Legislative Update: Proposal NLRB Rules About Misclassifying Workers
Thanks to a decision made in August by the NLRB, employers who utilize a contractor workforce have one less worry. When a company receives a misclassification finding it comes with a host of problems including benefits, wage and hour, taxation and so on. At least now they won’t have to worry about an unfair labor practice charge (ULP).
After reviewing arguments in Velox Express, Inc the NLRB ruled that a finding of misclassification alone should not result in an unfair labor practice charge. Key consideration in the ruling included that a misclassification does not threaten discipline as a consequence. However, if the employer were to violate TIPS – threats, interrogation, promises, surveillance, that would be a violation. The ruling allows employers to engage in independent contractor relationship without the threat of an ULP as long as it is entered into in good faith and belief of good intention.
