Legislative Update: January 2021

Possible Changes Under the Biden Administration

Along with a very welcome new year, the United States will also get a new President.  As President-elect Joe Biden prepares to take office in January 2021, employers should be prepared for a number of changes in 2021 and beyond.  First, many employment attorneys predict that President-elect Biden will reinstate an Obama-era workplace safety reporting rule.  If implemented, the rule would require certain employers to report detailed injury and illness information to the Occupational Safety and Health Administration.  OSHA would then publish the information online to put pressure on individual businesses to comply with workplace safety laws.

Next, employers can expect a sustained push toward a $15.00 per hour minimum wage, though perhaps not right away.  Many states, like Florida, have recently implemented gradual, yearly increases up to $15.00 per hour over the course of the next few years.  The federal minimum wage may follow a similar path, with incremental increases over the next four years.  The federal minimum wage was last raised in 2009.

Lastly, during his campaign, then-candidate Biden supported a legislative proposal for 12 weeks of paid leave for all workers for their own or a family member’s serious health condition – akin to a paid version of FMLA.  Depending on the makeup of the Senate following the January 2021 runoff in Georgia, this may or may not be a real possibility under the Biden administration.

While we cannot predict exactly what President-elect Biden will do after taking office, employers can be sure that his proposals, whether they make it through Congress or not, will vary wildly from those of the Trump administration.

Finally, with the new stimulus legislation passed by Congress on December 21, 2020 (and awaiting President Trump’s signature), employers can expect to see their obligation to provide paid leave under the Families First Coronavirus Response Act (FFCRA) eliminated after December 31, 2020.  While the new stimulus bill does not extend such paid leave, it does allow covered employers to voluntarily continue FFCRA-like benefits (assuming the employee still has eligible leave remaining) through March 31, 2020.  In exchange, those employers may qualify for certain tax credits originally associated with the leave.  In addition, the new bill extends the Pandemic Unemployment Assistance (PUA) benefits period through March 17, 2021 and expands the number of weeks for these PUA unemployment benefits from a 39-week period to a 50-week period.
