COVID-19 Vaccine Mandate Litigation
Kentucky employees push back on vaccine mandate.
On September 3, 2021, employees of St. Elizabeth Healthcare in Northern Kentucky filed suit against the hospital in response to its intent to mandate COVID-19 vaccinations for all hospital employees, absent a religious or medical exemption. The lawsuit alleges mandatory vaccinations are a “fraud upon the entire American public,” and the plaintiffs claim the proposed vaccine mandate requires they “participate in a medical experiment.” The St. Elizabeth’s mandate comes on the heels of a plea by Kentucky Governor Andy Beshear for private sector employees to require their employees to get vaccinated. Of note, the EEOC has indicated such mandates are permissible.
Similar efforts to eliminate vaccine mandates have failed.
A similar lawsuit filed by hospital employees in Texas was dismissed by the federal court in the summer of 2021. That lawsuit made allegations similar to those pending in federal court in Kentucky, including that employees were forced to participate in a “medical experiment” by being required to be vaccinated. Plaintiffs in the Texas case likened the COVID-19 vaccination requirement to the medical experimentation undertaken by Nazis in World War II concentration camps, a comparison the Texas judge called “reprehensible.” Notably, as with the Texas case, all previous attempts by employees nationwide to overturn an employer vaccine mandate through litigation have failed.
President Biden announces vaccine mandate for employers with 100 or more employees.
The St. Elizabeth’s lawsuit was filed less than one week before the Biden administration announced it would require all employers with 100 or more employees to either ensure their workers are vaccinated or require unvaccinated employees to submit to weekly COVID-19 testing. This rule will take the form of an Emergency Temporary Standard (ETS) from the Occupational Health and Safety Administration (OSHA), and it is estimated that it will impact approximately 80 million workers nationwide.
The Department of Labor has indicated that the ETS will be issued in the “coming weeks” but has not set a date certain for its release. Once issued, states where the federal government does not have jurisdiction over workplace safety (like Kentucky, for example) will have a short period of time to either adopt the ETS or “just-as-effective measures.” The ETS will remain in place for six months, and after that time elapses, it must be replaced by a permanent OSHA standard. It is unclear at this time how the ETS and possible permanent OSHA standard will impact ongoing litigation regarding the vaccine mandate, but it likely means the plaintiffs will have a harder uphill battle to fight a mandate as a condition of employment.

Breast self-exams: The newest technique
Did you know? The American Cancer Society’s guidelines about how women should perform breast self-exams have recently changed. Before, it was recommended that women examine their breasts in the shower. Newer guidelines suggest exams be done lying down so that the breast tissue spreads out more evenly, which makes it easier to feel all of the tissue present. Some women choose not to perform these exams as often as they should, or at all for that matter, because they are uncomfortable and unsure about how to go about it. Fortunately, it’s easier than most think. And the more a woman performs a self-exam, the better her chances of recognizing when an abnormality is present.

Donations Needed for Annual SHRM Foundation Fundraiser
As you may know, LSHRM will be holding its annual fundraiser to benefit the SHRM Foundation, “A Royal Affair with LSHRM – Annual SHRM Foundation Fundraiser” on Tuesday, October 12th from 6:30 p.m. – 9:00 p.m. This event will be held virtually, and a Silent Auction will be hosted on GiveSmart. All proceeds will go to the SHRM Foundation.
We are soliciting donations of gift baskets and gift cards from board members, LSHRM members and other community partners to help make this fundraiser successful. Even if you are unable to donate a basket, we welcome individual items to create a basket.

JA Inspire Virtual - LSHRM Volunteers Needed October 26-28, 2021 Join us for a virtual coalition of educators and industry leaders, led by Junior Achievement of Kentuckiana. At the Center of JA’s work is a powerful, virtual career exploration event that will be massive, measured in student engagement and impact. Businesses and organizations from the Kentuckiana region will be joining together for three days to allow students to pop in and learn more about industry sectors and future areas of employment interest. Once again, this year, LSHRM will be hosting a booth at this virtual event, which takes place from 8am-1pm daily on October 26th, 27th and 28th.
